Trainer Jillian Michaels in Hot Water?

"Biggest Loser" trainer Jillian Michaels is being sued by a woman who used a weight-loss product known as "Calorie Control," a supplement that Michaels endorses. The suit says that the advertising claims featuring Michaels suggest that all you need to do is take the pills before meals, and you'll lose weight. According to an Associated Press article at MSNBC, the lawsuit states:

"Ms. Michaels knows better -- taking two pills before eating does not miraculously cause weight loss," and that the consumer is suing for an unspecified amount.

Hmm... if Ms. Michaels should have known better... shouldn't the consumer have, too? Or, could she have been so desperate to lose weight that she truly believed it was that simple?

Is the company to blame? Should the manufacturer be held liable for making false claims? Or does all advertising overstate a product's effectiveness or quality to some extent?

Who is at fault here? Is Michaels out to make a quick buck so much that she doesn't care she is making a false statement about a product? Is Michaels really to blame or is it a case of "Buyer Beware" since we all know deep down a pill can't do it for us?

The pills work as a supplement to weight loss combined with a good diet and regular exercise. This woman needs to get a reality check because a pill cannot burn calories. She needs to educate herself before suing major companies.

Seriously?! If she is that naive, believing taking a pill will make you lose weight, she needs to spend more time pushing away from the table rather than waste other people’s time with such foolishness. Better yet, here’s a FREE tip: drop the pills and drink water first. Oh, but don’t sue me b/c I didn’t specify the amount of water! lol

It’s quite possible that this particular consumer knew full well that the product was not going to own up to its claim. Nevertheless, companies and celebs need to be much more careful about the claims they make. They know that a certain percentage of people are gullible especially when a message is being presented by a famous person perceived as being credible in their field, expertise or industry; hence the reason why companies pay celebs hefty payment for endorsements.

michaels is wrong to incite others thinking that she ma have discovered something– we want to believe others tell the truth, are honest–isnt it better to believe and not be falsely promised something than to go through life constantly trying to figure out the lies and bs?? there is enough of that out there–make people accountable and responsible for what they pretend–esp to MAKE money…

Okay…first I wish I had thought of the idea to sue someone because a pill didn’t make me lose weight. I mean, COME ON! Secondly, I know damn well if you read the fineprint on that bottle it will tell you the PROPER way to lose weight with the pill as a supplement! Jillian Michaels is the smartest, best trainer in the world who offers advice every week on The BL. So, should I go sue because I had Subway for dinner last night, and I didn’t lose any weight!? GET A GRIP!

We gain weight over time but we want a quick fix, like we take fast food gain weight, we also want fast something to lose the weight, it is crazy. We should all get down to the basics, eat right, eat right, all the time and then get moving

Like Cher once said, if it came in a bottle everyone would have a great body! With that said, I’m tired of the false advertisements. Yes, I think the company should be held responsible for false advertisements. I think any company that advertises their product should advertise the truth or be held liable for it. They prey on vulunerable people and take their money.

I totally agree with the last comment. It says on the bottle that it can only work with proper diet and exercise. I have tried these and the do help to curb my appetite some but I still have to pull myself away from the table. I know how dis- hearting it is to try and lose weight because after a 50 pound weigh lost I have been yo yo ing the last 10 for a year. But nothing beats good old fashion exercise

its the same as suing because you spilt hot coffee on yourself claiming there was no warning……its beyond ridiculous stupid people do stupid things and any person with a brain knows no pill alone will do a miracle or wouldnt we all be perfect and any judge who has ever listened to anything she says would know she will endorse better eating and exercise before a pill alone for my own sake im going to read the label because i just dont understand this

Get a life already! If taking a pill was all we needed to loose weight then all of us would look like Barbie. Please I know your smarter than to think that it only takes a pill.. Or.. is it that you want to sue for money so you can get lipo or have your stomach stapled or even a gastric by pass!
If you honestly believe that it’s a one pill cure for all the weight you are carring then I feel sorry for you.
But personaly I think your in it for the money! not because of the so called commercial that you say says all you do is take a pill. Read the fine print and maybe instead of a box of pills to loose weight invest in some serious help! Join Weight Watchers or Jenny Craig! Or join a gym. Maybe try walking or some type of physical work out program. But please don’t let us think that your ignorant! Spend your time investing in a weight loss program not a pill. I haven’t read the box on this product but you can be sure I will. I will also read the fine print.

jillian’s credibility is history with me……she knows the pills are a rip off and anyone who buys the stupid myths re any diet pills deserves to gain weight. just take a vitamin, eat right and excercise…….isn’t that the mantra jillian was famous for? she was out for the buck.

We live in a litigous society. Just like the buyer should know there is no miracle pill, Jillian Michaels knew when she endorsed the product she opened herself up to liability. This is the world in which we live! Jillian is trying to get paid and so is the woman suing her. Good luck to both.

There was a time once when companies making claims about their products where held to a standard of truth in advertising. Unfortunately, that has gone out the window along with unbias news journalism. It’s past time that we forced companies to give us exactly what they are advertising/claiming. The pictures of the products at fast foods restaurants is a good start. When was the last time you actually got a taco at Taco Bell that looked like the advertising picture?!

The only person at fault is the consumer. The consumer is responsible for his/her own choice, no matter who is endorsing the product.

Seriously!!! This is a pure example of the abuse that takes place throughout thelegal system!!! Everyone trying to lose weight knows that if it sounds too good to be true then it probably is. I agree that false advertisement is unfair to consumers, but you would think that with its prevalence these days that we would be wiser shoppers. Not to mention that this woman has no case! Endorsements in general exist to entice us to buy something that a famour person tells us to buy. Do people sue Chuck Norris and Christly Brinkley if they dont get the results they want from a total gym? Or does the average joe sue an athlete because the item they endorsed doesnt make them move faster? Its a joke…

I’m really disappointed in Ms Michael’s. Given her health history and back ground I had thought she would have been one of the least likely to offer such products. But too, I had seen her website and products and being an experienced Weight Loss and Fitness devote I knew better than to believe her ads. But she knew that there are so many out there desperate for a quick fix that she was inevitably going to make a LOT of money. In my opinion, what goes around; comes around. I’m sure she also has enough funds and legal representation that this will languish a LONG time before any decisions or refunds are made if ever to any one. Hopefully that will be the worst repercusions of her products and no one becomes ill or dies of a bad reaction to ‘whatever’ is in the product.

this is a huge ripoff. they bill your account right away. they billed me for $52 for nothing but access to a website for 3 months. then they say they “can’t” do anything to remove the charge after it’s billed. b.s.

It’s not Ms Michaels fault that the woman didn’t take care of herself physically! Sorry your too lazy to get off the couch and actually run for 30 minutes to an hour! It is no one elses fault but yours if your overweight. It’s your body and your responsibility for taking care of your body… no one else! Suing Ms Michaels is almost like saying you force feed me junk food then gave me a non-miracle pill 2 take. No, you chose to do that, ergo your fault. Take responsibility for your own actions.

I don’t understand how this could even go to court. All the material that Jillian Michaels puts out emphasizes the importance of a good, organic diet and exercise. She always states that there is no shortcuts for hard work. I also think people need to learn what SUPPLEMENT means. This woman is in a long line of idiots and people like her a just an abuse and shame to the legal system.
